Terms of Service

1. Introduction

Welcome to MD Homecare. These Terms of Service ("Terms") govern your use of our services, website, and related platforms. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

MD Homecare provides disability support and home care services as part of the National Disability Insurance Scheme (NDIS) and other care programs in Australia.

2. Service Agreement

Before commencement of services, clients (or their authorized representatives) will be required to enter into a formal Service Agreement with MD Homecare. This agreement will outline:

  • The specific services to be provided
  • Service schedules and duration
  • Applicable fees and funding arrangements
  • Rights and responsibilities of both parties
  • Cancellation and termination policies

The Service Agreement, once signed, forms part of these Terms of Service.

3. Our Services

MD Homecare offers a range of disability support and home care services, including but not limited to:

  • Personal care assistance
  • Domestic assistance
  • Community access support
  • Respite care
  • Clinical care
  • Therapy services
  • Supported Independent Living (SIL)

The availability and scope of services may vary depending on location, staff availability, funding arrangements, and individual needs assessment.

4. Your Responsibilities

As a client of MD Homecare, you agree to:

  • Provide accurate and complete information about your needs, medical history, and support requirements
  • Treat MD Homecare staff with respect and dignity
  • Maintain a safe environment for service delivery
  • Provide reasonable notice for service changes or cancellations as outlined in your Service Agreement
  • Make payments for services as agreed upon (if applicable)
  • Comply with NDIS rules and regulations (for NDIS participants)
  • Inform MD Homecare of any changes to your circumstances that may affect service delivery

5. Fees and Payment

Fees for our services are outlined in your Service Agreement and may be:

  • Funded through the NDIS for eligible participants
  • Covered by Home Care Packages or other government programs
  • Paid privately by clients

For privately paid services, payment terms are outlined in your Service Agreement. Failure to make payments as agreed may result in suspension or termination of services.

All fees are subject to change with reasonable notice, and in accordance with applicable laws and regulations.

6. Cancellation Policy

Our cancellation policy aligns with the NDIS Price Guide for NDIS-funded services and is detailed in your Service Agreement. Generally:

  • Cancellations with adequate notice (as specified in your Service Agreement) will not incur charges
  • Late cancellations may result in full or partial service charges
  • Repeated cancellations may affect service scheduling and availability

We understand that emergencies happen, and we will work with you to accommodate genuine emergency situations.

7. Privacy and Confidentiality

MD Homecare is committed to protecting your privacy and maintaining the confidentiality of your personal and health information. Our collection, use, and disclosure of your information is governed by our Privacy Policy and applicable privacy laws.

By using our services, you consent to our collection, use, and disclosure of your information as outlined in our Privacy Policy.

8. Feedback and Complaints

We value your feedback and are committed to continuous improvement. If you have any concerns or complaints about our services, please contact us directly to discuss the matter.

We have a formal complaints procedure that ensures all complaints are handled fairly, confidentially, and promptly. If your complaint cannot be resolved directly with us, you may also contact the NDIS Quality and Safeguards Commission or other relevant authorities.

9. Limitation of Liability

To the extent permitted by law, MD Homecare's liability for any loss or damage suffered by you in connection with our services is limited to:

  • Resupplying the services; or
  • Paying the cost of having the services resupplied

MD Homecare is not liable for any indirect, special, or consequential loss or damage, loss of profit, or loss of opportunity.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation that cannot lawfully be excluded or limited.

10. Termination of Services

Either party may terminate the Service Agreement with notice as specified in your Service Agreement. MD Homecare reserves the right to terminate services immediately if:

  • You breach these Terms or your Service Agreement
  • The safety of our staff is compromised
  • The service environment is unsafe
  • Funding is withdrawn or exhausted
  • We can no longer provide the services you require

Upon termination, you are responsible for payment of any outstanding fees for services provided.

11. Changes to Terms

MD Homecare may update these Terms from time to time to reflect changes in our practices or legal requirements. The updated Terms will be posted on our website, and the revised version will be effective from the date of posting.

Continued use of our services after any changes to these Terms constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
